India’s industrial landscape has witnessed unprecedented growth over the past few decades, yet this economic expansion has come with a troubling cost. Behind the gleaming factories and ambitious construction projects lies a harsh reality: thousands of workers lose their lives every year in preventable industrial accidents. Despite the existence of safety legislation, enforcement remains weak, and the vast majority of workers remain unprotected by existing laws.

A grim safety record despite industrial progress

India’s occupational safety record stands in stark contrast to its economic achievements. While the country has experienced significant industrial growth, worker safety has not kept pace with this development. Estimates suggest that nearly 48,000 work-related deaths occur annually in India, a figure that is approximately 20 times higher than in Britain.

The root of this crisis lies not in a lack of legislation but in its inadequate implementation. Existing safety laws cover only a fraction of India’s massive workforce, leaving millions vulnerable to hazardous working conditions. High unemployment rates and an abundance of unskilled labor create an environment where workers have little bargaining power and are often forced to accept dangerous conditions just to earn a living.

Construction sector: A daily death toll

The construction industry, which employs 51 million workers and contributes nine percent to India’s GDP, has earned the unfortunate distinction of being the second most hazardous sector in the country. Research indicates that approximately 38 fatal accidents occur daily in the construction sector, with falls from height, electrocutions, and collapsing walls and scaffolding being the leading causes of death.

These staggering numbers reflect systematic failures in safety management. Construction workers regularly report that contractors fail to provide basic personal protective equipment. Safety inspections are infrequent, and when accidents do occur, they are often underreported. The problem is compounded by the fact that most construction workers are migrants from rural areas who lack local support networks and can be easily exploited by contractors prioritizing speed and cost over safety.

Why construction sites remain deadly

Several factors contribute to the high fatality rates in construction. Workers receive minimal or no safety training before being assigned to hazardous tasks. Less than 30 percent of construction workers have completed secondary education, and only one in ten receive work-specific training. Many workers operate under daily verbal contracts with no written agreements, making it difficult to hold employers accountable when accidents occur.

The lack of regulatory oversight is glaring. There is approximately one safety inspector for every 506 registered units in India, making comprehensive site inspections virtually impossible. Even when violations are identified, penalties are often too low to incentivize companies to improve safety standards. The temporary nature of construction work also discourages contractors from investing in worker training and safety infrastructure.

Mining sector: Hidden casualties

The mining industry presents another alarming picture of workplace safety in India. Government data revealed that 377 workers involved in mining coal, minerals, and oil were killed in accidents between 2015 and 2017, with more than half of these fatalities occurring in coal mines.

One mine worker dies every six days on average in India, making it one of the world’s most dangerous countries for coal miners. The actual death toll is likely much higher, as many accidents go unreported, particularly in illegal mines. In Meghalaya, for instance, thousands of workers, including children, have been involved in dangerous rat-hole mining operations where miners crawl into narrow shafts on bamboo ladders to extract low-quality coal.

Contributing factors to mining accidents

The primary causes of mining fatalities include roof and bunker collapses, inadequate safety equipment, and insufficient workforce training. Underground mines face particularly hazardous geo-mining conditions that differ significantly from opencast operations. Despite these known risks, health and safety precautions remain inadequate across the sector.

Industry experts point to several systemic issues: shortage of trained manpower, unrealistic production targets, unplanned extraction methods, and heavy reliance on untrained contract workers in critical areas. Even state-owned mining companies have been criticized for not fully utilizing their safety budgets and for outsourcing coal production to third parties that prioritize profit over worker welfare. When accidents do occur, compensation remains inadequate, with families receiving only a fraction of what would be considered fair compensation for the loss of life.

The coverage gap: Millions left unprotected

Perhaps the most critical issue facing Indian workers is the massive gap in legal coverage. More than 90 percent of India’s workforce operates in the unorganized sector, yet occupational health management systems and their benefits remain largely limited to the organized sector. This means that the vast majority of workers have no legal protection against hazardous working conditions.

The unorganized sector includes agriculture, small-scale construction, informal manufacturing, and numerous other industries where workers lack written contracts, social security benefits, and access to occupational health services. These workers face high risks but have minimal recourse when accidents occur. Police are often reluctant to file First Information Reports when accidents happen, instead opting for Accidental Death Reports that carry fewer legal implications for employers.

Why the unorganized sector remains vulnerable

Several factors perpetuate this coverage gap. The transient nature of informal employment makes it difficult to enforce regulations or ensure workers receive benefits. Many small establishments operate outside designated industrial zones, making them harder to monitor. Additionally, the concept of occupational health remains poorly integrated with primary healthcare services, further isolating workers in the unorganized sector from support systems.

Poverty adds another layer of vulnerability. Low-income youth are more likely to work in high-risk occupations such as agriculture, mining, and construction. Child labor, though legally prohibited, persists due to poverty and contributes to long-term health problems. Without access to occupational health specialists or even basic workplace safety training, these workers remain trapped in a cycle of exploitation and risk.

Legislative framework exists but implementation fails

India has comprehensive legislation designed to protect workers, including the Factories Act of 1948, the Building and Other Construction Workers Act of 1996, and the Mines Act of 1952. In 2020, the government introduced the Occupational Safety, Health and Working Conditions Code to consolidate various labor laws and extend protections to a broader workforce.

However, laws on paper have not translated into protection on the ground. Weak enforcement mechanisms, insufficient numbers of inspectors, inadequate penalties for violations, and corruption all contribute to the implementation gap. Many employers view safety regulations as obstacles to business rather than as essential protections for human life. The recent changes that prevent inspectors from conducting unannounced inspections have further weakened the system.

The contrast with developed nations is stark. While Britain reported only 137 workplace fatalities across all sectors in 2016, India experienced tens of thousands of deaths during the same period. This disparity cannot be explained by differences in workforce size alone; it reflects fundamental differences in safety culture, regulatory enforcement, and the value placed on worker welfare.

The path forward: What needs to change

Addressing India’s industrial safety crisis requires action on multiple fronts. First, the coverage of safety laws must be genuinely extended to the unorganized sector, with practical mechanisms to ensure compliance in small establishments and informal work settings. This includes developing sector-specific safety programs for high-risk industries like construction and mining.

Second, enforcement must be strengthened dramatically. This means hiring more qualified safety inspectors, conducting regular unannounced inspections, and imposing penalties that genuinely incentivize compliance. Companies that repeatedly violate safety standards should face meaningful consequences, including suspension of operations and criminal liability for management.

Third, investment in worker training is essential. Every worker should receive comprehensive safety training before being assigned to potentially dangerous tasks. This training should be mandatory, properly funded, and regularly updated to reflect emerging risks. Employers must provide adequate personal protective equipment at no cost to workers.

Finally, accident reporting and data collection systems need significant improvement. Accurate information about workplace accidents is essential for understanding the true scale of the problem and developing effective prevention strategies. Underreporting must be addressed through systems that protect workers who report accidents from retaliation.
